Premium Customers accessing this tool agree to the following Terms & Conditions:
(1) Premium Customer may use the Licensed Information internally and may redistribute the Licensed Information to its end users who have agreed to terms substantially similar those outlined herein;
(2) Premium Customer shall not acquire proprietary rights in or to the Licensed Information, which rights remain in Licensee's suppliers and licensors and Premium Customer acknowledges that the Licensed Information is a valuable commercial product, the development of which has involved the expenditure of substantial time and money;
(3) Premium Customer acknowledges that the Licensed Information is sourced from public documents or statistical calculations, is provided on an "as is, as available" basis with all faults and defects, and Licensee's suppliers and licensors do not make any warranties, express or implied, including without limitation, those of merchantability and fitness for a particular purpose, nor are Licensee's suppliers and licensors responsible for errors, omissions, miscalculations, or misrepresentations of value; and
(4) Any use of the Licensed Information by Premium Customer shall be at its own risk, and Premium Customer agrees to hold harmless Licensee's suppliers and licensors with respect thereto.
